The Texas Municipal Power Agency (TMPA) is a joint powers agency and
state political subdivision created in 1975 by the Cities of Bryan,
Denton, Garland, and Greenville, Texas. TMPA’s sole business is the
generation and transmission of electricity for its member cities. TMPA
owns and operates a number of high voltage electric transmission lines
that were constructed to deliver electricity from Gibbons Creek to the
Member Cities.
With the Federal Energy Regulatory Commission (FERC) Order No. 888 and
similar “deregulation” in the State of Texas, TMPA’s transmission
facilities were made available to third parties interested in wheeling
across these facilities. EES Consulting has assisted TMPA in complying
with the rules related to transmission access and pricing set forth in
both state and federal regulation.
EES Consulting’s representation of TMPA as an expert in transmission
rates began with the opening of the Texas electricity market and
continues to this day. EES Consulting has provided expert witness and
strategic support to TMPA on numerous occasions. Services provided by
EES Consulting to TMPA in, and in support of, the various regulatory
proceedings include:
- Performed required cost studies in numerous Transmission Cost of
Service (TCOS) filings by TMPA to the Texas Public Utilities Commission
(TPUC)
- Provided expert witness testimony and exhibits in support of TMPA’s TCOS rate applications before the TPUC
- Provided expert witness testimony and exhibits in support of TMPA
in antitrust litigation brought against the agency in Federal District
Court by the City of College Station
- Provided expert witness testimony and exhibits in support of TMPA in rate applications made at FERC
- Assisted in the filing of TMPA’s “Earnings Monitoring Report”
- Reviewed testimony of interveners in cases related to TMPA
- Provided rebuttal testimony
- Developed and responded to interrogatories related to the above regulatory and legal proceedings involving TMPA
- Provided information for and participated in negotiated settlement discussions
